General Terms and Conditions of Sale

We thank you for the trust you place in us and take your rights fully into consideration. The general terms and conditions of sale set out below enable you to be fully aware of your legal situation each time you visit our website and place an order through it.

  1. Applicability of the General Terms and Conditions of Sale

All the orders placed via the Internet with Bains de Lavey, hereafter called the Company, are governed by these General Terms and Conditions of Sale, which shall apply to the exclusion of any other terms and conditions. By placing an order, you acknowledge that you have read, understood and accepted, without any reservation, these General Terms and Conditions of Sale.
    2. The Company reserves the right to change its General Terms and Conditions of Sale at any time by publishing a new version on this website. Any order placed after publication by the Company of the new version of its General Terms and Conditions of Sale implies acceptance of these.
  2. Registration
    1. After having chosen the products, the buyer must identify him/herself to be able to purchase the selected items by filling in the form in a complete and honest manner, completing the fields shown on the form.
    2. Please inform the Company of any change of address and other changes.

  3. Orders
    1. By placing an order on this website, you undertake to buy the products you have selected in accordance with these General Terms and Conditions of Sale.
    2. The orders and reservations you place with the Company on this website may be subject to minimum or maximum limits on quantities.
  4. Order confirmation
    1. The orders that you place on this website shall not constitute a binding contract until they have been confirmed by an e-mail from the Company
    2. The Company reserves the right, at its sole discretion, to refuse an order, in particular in the case of unpaid bills or insolvency.
    3. The data recorded by the Company shall constitute irrefutable proof of the order or the transaction. The data recorded by the payment system shall constitute irrefutable proof of the financial transactions.
    4. The customer will receive an order confirmation by e-mail.
  5. Prices
    1. The prices payable for the requested services are those listed on this website on the date the order is placed, inclusive of VAT.
    2. The Company reserves the right to change its prices at any time, and to cancel any contract that contains descriptive, printing or calculation errors.
  6. Delivery
    1. All the orders confirmed by the Company shall be delivered to the address indicated on the order form.
    2. Where payment is by credit card, the Company shall do its utmost to ensure delivery within four working days following receipt of the order. In case of payment by invoice, the order shall be delivered within seven working days after receipt of payment.
  7. Inspection of the goods
    1. It is your responsibility to verify the quantity and the delivery slip.
    2. f you notice a fault you must report this by informing the Company within 5 days following the delivery. The Company shall rectify this immediately after having been informed.
  8. Payments and gift vouchers
    1. In case of payment by invoice, this will be sent to you within two working days after receipt of the order. To make a payment, please use the payment slip attached to the invoice. If the address is outside of Switzerland, we will send you our bank details; please include the invoice number in your communications. The date on which payment is received shall be applicable for the delivery. We reserve the right to cancel unpaid invoices after more than a month, without giving prior notice.
    2. Payments by credit card are made on the secure site of Postfinance. You will be automatically redirected to their website when your order has been validated. No information about your card will be asked for or recorded on our website.
    3. Gift vouchers cannot be reimbursed or exchanged.
    4. Gift vouchers remain valid for one year from the issue date.
  9. Languages
    1. Our website is available in four languages, in case of a dispute, the French version shall prevail.

The Company accepts no responsibility in the event of mistakes or omissions in the photos or texts on this website.   11. Force majeure
    1. The Company will do its utmost to fulfil its obligations, but cannot be held liable for any delay or failure to deliver arising from circumstances beyond its control, such as strikes, wars, natural disasters or others that prevent the production, transport or delivery of products.
    2. In case of delay, the Company shall discharge its obligations as soon as possible.
  12. Applicable law and place of jurisdiction
    1. These General Terms and Conditions of Sale shall be governed by Swiss law.
    2. The exclusive place of jurisdiction shall be Lavey-Morcles.
